Welcome to DippyHopper.
These Terms & Conditions govern your use of the DippyHopper website, your DippyHopper account, your purchase of products, your participation in DippyHopper membership programmes, and your use of our community buying and Pickup Point services.
By accessing our website, creating an account, placing an order or purchasing a DippyHopper Membership, you agree to these Terms & Conditions.
If you do not agree with these Terms & Conditions, please do not use the DippyHopper website or services.
1. About DippyHopper
DippyHopper is a South African community-focused retailer that helps households save on everyday groceries and household essentials through bulk purchasing, community buying, member pricing and value-focused bundles.
DippyHopper operates primarily through online ordering and designated community Pickup Points.
DippyHopper does not currently offer home delivery.
Orders must therefore be collected from the Pickup Point selected during checkout or otherwise communicated to you by DippyHopper.
2. Definitions
In these Terms:
“DippyHopper”, “we”, “us” or “our” means DippyHopper and the applicable legal entity operating the DippyHopper service.
“Customer”, “you” or “your” means any person who accesses the website, creates an account, purchases products or uses a DippyHopper service.
“Product” means any grocery, household essential, bundle or other product offered for sale through DippyHopper.
“Order” means a request submitted by you to purchase Products through the DippyHopper website.
“Pickup Point” means a designated location from which customers may collect completed DippyHopper orders.
“Membership” means a DippyHopper membership plan purchased by a customer.
“Member” means a customer whose DippyHopper Membership is active.
3. Eligibility
You may use DippyHopper if you are legally capable of entering into a binding agreement under South African law.
If you are under the age required to enter into a binding contract, you must use DippyHopper with the involvement and consent of a parent or legal guardian.
You are responsible for ensuring that the information provided to DippyHopper is accurate and up to date.
4. Your DippyHopper Account
Certain DippyHopper services may require you to create an account.
You are responsible for:
- Providing accurate information;
- Keeping your login credentials confidential;
- Maintaining the security of your account;
- Notifying us if you believe your account has been compromised; and
- Ensuring that information associated with your account remains current.
You must not use another person’s account without permission.
DippyHopper may suspend or restrict an account where we reasonably believe that it is being used fraudulently, unlawfully or in a manner that may harm DippyHopper or other customers.
5. Products and Product Information
We make reasonable efforts to ensure that product descriptions, images, prices, pack sizes and availability displayed on the website are accurate.
However:
- Product images may differ slightly from the actual packaging;
- Manufacturers may change packaging or labelling;
- Product availability may change;
- Product specifications may occasionally be updated; and
- Minor differences may occur between website images and the physical product.
Where a material error affects an order, we will contact you and provide an appropriate remedy.
6. Product Availability
Products are subject to availability.
Placing an order does not necessarily guarantee that every product will remain available until the order is prepared for collection.
If a product becomes unavailable after you place an order, DippyHopper may contact you to discuss:
- A suitable replacement;
- Removal of the unavailable product and an applicable refund; or
- Cancellation of the affected order.
We will not knowingly substitute a materially different product without your agreement.
7. Prices
All prices displayed on DippyHopper are in South African Rand (ZAR).
Unless expressly stated otherwise, displayed prices include applicable VAT.
Prices may change from time to time. The price applicable to your purchase will be the price displayed at the time your order is placed, subject to correction of obvious pricing errors and applicable law.
DippyHopper may offer different prices to Members and non-members.
Where member pricing applies, the customer must have an active qualifying Membership at the time the applicable price is determined.
8. Community Buying and Volume Pricing
DippyHopper may offer community buying, volume pricing or threshold-based pricing.
Where such pricing is offered:
- The applicable threshold will be displayed or otherwise communicated;
- Pricing may depend on total community demand or order quantities;
- The final applicable price may depend on the conditions of the specific buying cycle; and
- Any applicable adjustment or credit will be handled in accordance with the terms displayed for that particular offer.
Not every product will necessarily participate in every community buying cycle.
9. Value Bundles
DippyHopper may offer pre-configured value bundles containing multiple products.
Bundle contents, quantities and prices will be displayed with the relevant bundle.
Unless otherwise stated, purchasing a bundle constitutes the purchase of the bundle as a defined product offering rather than separate purchases of each component.
DippyHopper may update bundle contents from time to time.
10. Orders
When you place an order, you are making an offer to purchase the selected Products under the applicable terms.
You are responsible for reviewing your order before submitting it, including:
- Products;
- Quantities;
- Prices;
- Membership discounts;
- Pickup Point;
- Contact details; and
- Total amount payable.
Once an order has been submitted, we will provide an order confirmation or other acknowledgement.
An order may be cancelled or adjusted where:
- Payment is unsuccessful;
- A Product is unavailable;
- There is an obvious pricing or product-description error;
- Fraudulent activity is suspected; or
- Required information cannot reasonably be verified.
Where you have already paid and the order cannot be fulfilled, we will process an appropriate refund in accordance with applicable law and our Refund & Returns Policy.
11. Payment
Payments may be processed through the payment methods made available during checkout.
Where PayFast is offered, payment is processed through the PayFast payment platform.
DippyHopper does not receive or store your full card details where payment is processed through an external payment provider.
An order is only regarded as paid once payment has been successfully confirmed through the applicable payment system.
12. Pickup-Only Service
DippyHopper currently operates a pickup-only fulfilment model.
We do not currently provide home delivery.
When placing an order, you must select an available Pickup Point.
Pickup details, including:
- Location;
- Collection date;
- Collection time or collection window; and
- Any special collection instructions
will be displayed during checkout or communicated to you after ordering.
13. Collection of Orders
You should inspect your order when collecting it.
Where reasonably possible, you should notify DippyHopper immediately if:
- An item is missing;
- An incorrect product was supplied;
- An item is visibly damaged; or
- The order materially differs from what you ordered.
Your statutory rights are not limited by any requirement to report an issue immediately.
If another person collects your order on your behalf, you remain responsible for ensuring that the person is authorised to collect it.
DippyHopper may require reasonable identification or order information before releasing an order.
14. Uncollected Orders
You are responsible for collecting your order within the stated collection period.
If an order is not collected:
- DippyHopper may contact you to arrange an alternative collection time;
- Products may be subject to storage limitations, particularly food or other products that may deteriorate;
- Additional reasonable arrangements may be required for delayed collection; and
- Where an order cannot safely or reasonably be retained, DippyHopper may cancel the affected order and process any applicable refund in accordance with law.
Nothing in this clause limits any statutory consumer right.
15. Product Quality and Consumer Rights
DippyHopper is committed to supplying products that comply with applicable South African consumer protection requirements.
Nothing in these Terms & Conditions excludes or limits any right or remedy that cannot lawfully be excluded or limited.
Where goods are defective, unsafe, not of acceptable quality, unsuitable for their intended purpose or otherwise fail to comply with applicable legal requirements, you may have rights to return the goods and obtain a repair, replacement or refund as provided by law.
Our Refund & Returns Policy explains how to initiate a return or refund request.
16. DippyHopper Membership
DippyHopper may offer Membership plans with monthly and annual billing options.
The current Membership packages may include:
- DippyHopper Saver
- DippyHopper Value
- DippyHopper Advantage
Membership benefits, pricing and billing frequency will be displayed before purchase.
Membership is intended to provide access to applicable DippyHopper member benefits, which may include member pricing, community buying opportunities, volume or threshold pricing and other benefits described on the website.
Membership benefits may differ between plans.
17. Membership Billing
Where a Membership is purchased on a recurring basis, the applicable recurring payment arrangement will be disclosed before purchase.
You authorise the applicable payment provider to process recurring payments according to the Membership plan selected.
Membership remains active while payments remain valid and the Membership account is not otherwise cancelled, suspended or expired.
If a recurring payment fails, DippyHopper may provide a grace period during which you can resolve the payment issue.
The default grace period is seven days unless otherwise stated for the applicable Membership.
18. Membership Cancellation
You may request cancellation of a recurring Membership through the available account or support channels.
Cancelling a recurring Membership normally stops future renewals.
Unless otherwise required by law or our Refund & Returns Policy, cancellation does not automatically entitle you to a refund of a Membership period that has already been paid for.
Where applicable, your Membership will remain active until the end of the period for which you have already paid.
19. Membership Changes
DippyHopper may allow Members to change Membership plans.
Where a Membership is upgraded or downgraded, the applicable financial treatment and effective date will be communicated before the change is confirmed.
DippyHopper will not knowingly maintain multiple overlapping active Memberships for the same customer unless expressly permitted by a specific offer.
20. Promotions and Special Offers
Promotions, discounts and special offers may be subject to additional terms.
Where additional terms apply, those terms will be communicated with the relevant promotion.
Promotional offers may have:
- Start and end dates;
- Quantity limits;
- Membership requirements;
- Product exclusions; or
- Other eligibility conditions.
21. Prohibited Use
You must not:
- Use DippyHopper for unlawful purposes;
- Attempt to gain unauthorised access to our systems;
- Interfere with website security;
- Introduce malicious code;
- Use automated systems to abuse pricing or purchasing functionality;
- Create fraudulent accounts;
- Use payment methods without authorisation; or
- Deliberately exploit technical or pricing errors.
We reserve the right to investigate suspected abuse and take appropriate action.
22. Intellectual Property
The DippyHopper name, branding, logos, website content, graphics, software and other materials are protected by applicable intellectual property laws.
You may use the website for legitimate personal shopping purposes.
You may not reproduce, distribute, modify or commercially exploit DippyHopper content without permission, except where permitted by law.
23. Website Availability
We aim to keep DippyHopper available and reliable but cannot guarantee uninterrupted access.
The website may occasionally be unavailable because of:
- Maintenance;
- Upgrades;
- Hosting or network problems;
- Security incidents;
- Payment-provider outages; or
- Circumstances outside our reasonable control.
24. Third-Party Services
DippyHopper may use third-party services, including payment providers, hosting providers, analytics services and other technology providers.
Those services may have their own terms and privacy policies.
Your use of third-party services may therefore also be subject to those providers’ terms.
25. Limitation of Liability
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by South African law.
Subject to that limitation, DippyHopper will not be liable for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.
Nothing in these Terms & Conditions limits your statutory consumer rights.
26. Privacy
DippyHopper processes personal information in accordance with its Privacy Policy and applicable South African data-protection laws.
Our Privacy Policy explains:
- What personal information we collect;
- Why we collect it;
- How we use it;
- When it may be shared;
- How long it may be retained; and
- How you may exercise applicable privacy rights.
27. Changes to These Terms
DippyHopper may update these Terms & Conditions from time to time.
The latest version will be published on the DippyHopper website.
Changes will not retrospectively remove rights that you have already acquired under applicable law.
28. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with in accordance with applicable South African law and the applicable consumer-protection framework.
